Recharge and get rewarded

1. This "Shell Recharge - PRO-NET Promotion" ("Promotion") will commence from 12:00:00AM on 26 May 2025 to 11:59:59PM on 9 June 2025; both dates inclusive, which can be extended by Shell without prior notice ("Promotion Period")

2. This Promotion is organised by Shell Malaysia Trading Sdn. Bhd. (“Shell”) and Proton New Energy Technology Sdn. Bhd. (“PRO-NET”) (collectively, referred to as the “Companies”)

3. This Promotion is applicable at all Shell Recharge electric vehicle charging stations in Malaysia (“Participating Locations”), as listed on the Hello smart mobile app and PROTON e.MAS mobile app (“Mobile Apps”).

4. This Promotion is open to all registered users of the Mobile Apps in Malaysia (“Qualifying Participants”). Any electric vehicle recharging transaction made prior to the registration as a Qualifying Participant user shall not be considered valid.

5. To qualify for this Promotion, Qualifying Participants must successfully recharge their electric vehicle and pay for the charging using the Mobile Apps at Participating Locations during the Promotion Period (“Qualifying Purchase”).

6. Each Qualifying Purchase will be entitled to a discount, as follows:

a) For Qualifying Purchases made at Shell Recharge High Performance Charging bays located at Shell stations, the Qualifying Participant will be entitled to a thirty percent (30%) discount; and

b) For Qualifying Purchases made at all other Shell Recharge bays, the Qualifying Participant will be entitled to a ten percent (10%) discount.
(collectively, referred to as the “Discount”)

7. This Promotion is non-transferable, non-refundable, and non-exchangeable for cash, in kind or any of its equivalent.

8. In the event the charging session is interrupted or unsuccessful, and/or if the charging transaction is refunded or reversed for any reason whatsoever, there will be no Qualifying Purchase, and the Qualifying Participant will not be entitled to any Discount. The Companies shall under no circumstances whatsoever be liable hereof.

9. Strict fulfilment of all the steps under this paragraph is required, failing which the vehicle recharging transaction will not be qualified as a Qualifying Purchase. No correspondence or claims will be entertained in the event of such disqualification and the Qualifying Participant shall not be entitled to any payment or compensation whatsoever from the Companies. The Companies shall under no circumstances whatsoever be liable for any such disqualification.

General Terms and Conditions

10. Shell reserves the right at its sole and absolute discretion to vary, delete, or add to any these Terms and Conditions without prior notice, or to terminate this Promotion at any time without notice or liability.

11. These Terms and Conditions, as may be amended from time to time shall prevail over any provisions or representations contained in any other promotional material or advertising of this Promotion.

12. All Shell’s decisions on all matters in respect of this Promotion or in the event of any dispute are final and binding and no correspondence or appeals shall be entertained.

13. Shell reserves the right at its sole and absolute discretion to cancel, terminate, or suspend this Promotion without prior notice and without any liability. For the avoidance of doubt, cancellation, termination or suspension by Shell of this Promotion shall not entitle the Qualifying Participants to any claim or compensation against Shell for any and all losses or damage suffered or incurred by the Qualifying Participants as a direct or indirect result of the act of cancellation, termination, or suspension.

14. In no event shall Shell be liable for any loss or damages including without limitations, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion, even if Shell has been advised of the possibility of such damages are expressly excluded.

15. The invalidity, illegality, or unenforceability of any of these Terms and Conditions shall not affect or impair the continuation in force of the remainder of these Terms and Conditions of this Promotion.

16. By participating in this Promotion, the Qualifying Participants have read, understood and expressly agree and consent to:

a. be bound by these Terms and Conditions including all Shell’s decisions in relation to this Promotion;

b. allow Shell and its agencies to process and disclose to any third party, the necessary personal data of the Qualifying Participants provided by the Qualifying Participants for this Promotion for any and all purposes in relation to this Promotion and any and all other activity relating to or arising from the course of business or businesses of Shell;

c. allow Shell to collect, use, disclose and share amongst themselves and their respective service providers, the Qualifying Participants’ personal data, including the photographs or audio-video or other recordings of the Qualifying Participants for publicity and/or use in advertisements across all media, in its original or edited format, in relation to this Promotion without further notification, remuneration or compensation; and

d. authorise Shell to process the Qualifying Participants’ personal data provided pursuant to this Promotion in accordance with the Personal Data Protection Act 2010 (PDPA).

e. In the event:

i. Shell in its sole discretion, determines that any transaction may be suspicious, illegal, involves any criminal activities or involves any Discount that has been obtained through dishonesty or fraudulent means;

ii. Shell determines that a Qualifying Participants has abused any of the Promotion benefits and/or privileges, has failed to comply with any of these Terms and Conditions set out hereinabove, or has made any misrepresentation to Shell;

iii. Any of the Discount is no longer made available;

iv. The Discount has been issued to a Qualifying Participant in error or expired; and/or

v. Shell may at its sole discretion without any prior notice disqualify any Qualifying Participants and/or cancel the Discount or take any other actions, including appropriate legal action, as it deems fit.

17. Shell shall not be liable for any default of its obligation under this Promotion due to any force majeure events which include but not limited to act of God, war, riot, lockout, industrial action, fire, flood, drought, storm, epidemic and pandemic or any events beyond the reasonable control of Shell.

18. These Terms and Conditions shall be governed by the Laws of Malaysia and all Qualifying Participants are deemed to have agreed to submit to the exclusive jurisdiction of the Malaysian courts.
